ALLEGEDLY BOGUS "GOLD CARD" MARKETERS SETTLE FTC CHARGES

Operators of a plan sold "gold cards," representing them as Visa or MasterCards. However, these operators provided their own "merchant cards" that limited consumer use to purchases from their own catalogs or websites. These operators settled FTC charges that the "scheme" was deceptive and violated federal law.

The Court orders stemming from the settlements bar the operators from marketing any credit or merchant cards and from falsely claiming they will help consumers improve their credit by reporting credit histories to the credit reporting agencies. The orders also bar defendants from misrepresenting any product or service they're selling and requires that they disclose all information material to a consumer's decision to buy a product or service before sale. The defendants also are barred from deceptively charging for expedited delivery.

NOTE: Stipulated final judgments and orders are for settlement purposes only and do not constitute an admission by the defendant of a law violation. Because these orders were signed by the judge in the case, they have the force of law.

FDA, PHARMACIA UPDATE BEXTRA LABEL WITH NEW WARNINGS

The Food and Drug Administration (FDA) and Pharmacia are advising health care professionals about new warnings and information in the product labeling of the drug Bextra (valdecoxib). Bextra is a drug approved for treatment of osteoarthritis, rheumatoid arthritis and dysmenorrhea (menstrual pain). The labeling is being updated with new warnings following postmarketing reports of serious adverse effects including life-threatening risks related to skin reactions -- including Stevens Johnson Syndrome, and anaphylactoid reactions (serious allergic reactions). Also, the labeling will state that the drug is contraindicated -- not to be used -- in patients allergic to sulfa containing products.
