Do Your Advertising Claims Measure Up to Truth and Accuracy Standard?

Regardless of whether you advertise on the Internet or any of the new media--or you're a large advertiser making a broadcast network buy--there are many steps that you should take first--before you create that advertisement or place that media buy. And, of course, you should consult with a legal professional before you begin any advertising campaign. This article is a useful review of 10 key areas you should consider when you're reviewing your advertising to see if it complies with the numerous laws, rules, regulations and guidelines that may affect your ads.

Item #4. Be Sure Your Advertising Claims Measure Up to the "Truth and Accuracy" Standard.

Your ads will go a long way towards being challenge-proof if they follow the basic test spelled out by the National Advertising Division (NAD) of the Council of Better Business Businesses:

"truth and accuracy."

Indeed, the advertising industry's self-regulatory system (the NAD/National Advertising Review Board system) was designed "to foster high standards of truth and accuracy in national advertising."

You should be aware that the National Advertising Division (NAD) of the Council of Better Business Bureaus only reviews national advertising (i.e., ads that are disseminated on a nationwide or broadly regional basis). The advertisements reviewed by NAD may originate via broadcast (television or radio), cable TV, from the print media (e.g., newspapers, magazines) via the Internet or other sources. NAD does not review local advertisements. When a complaint involves a local advertisement, the best self-regulatory organization is the local Better Business Bureau (BBB).

Nevertheless, NAD is an excellent source of information for any advertiser who wishes to learn how to craft their advertising to comply with the myriad laws, rules, guidelines and regulations affecting this area. For example, the NAD Case Reports are an excellent of such information.
