In 2007 and 2008, there were several noteworthy developments in false advertising cases before the National Advertising Division (NAD) and the Children’s Advertising Review Unit (CARU). Our lead article, "Noteworthy Developments in NAD and CARU False Advertising Cases," by Jeffrey S. Edelstein, Esq. examines these key developments.

 

In April 2008, a federal court enjoined Tyson Foods' national ad campaign asserting that its chicken was "raised without antibiotics." The U.S. Department of Agriculture (USDA) expressly approved Tyson's advertising slogan, but Tyson was nevertheless enjoined. Our next article, "Chicken `Raised Without Antibiotics': The Latest Lanham Act Deception Case to Bring Down a National Advertising Campaign," by Randall K. Miller, Esq., discusses the impact of this important case.

 

FTC recently issued a Statement of Basis and Purpose (SBP) and final Discretionary Rule (the Rule) clarifying several of the requirements of the CAN-SPAM Act of 2003. Among other topics, FTC addressed how CAN-SPAM applies to "forward-to-a-friend" e-mail messages. Our next article, "FTC Issues New CAN-SPAM Guidance and Clarifies Position on `Forward-to-a-Friend' Programs," by Jason Kessler, Esq., discusses this important development.

 

A new FTC report on alcohol marketing and youth examined industry efforts to reduce the likelihood that alcohol advertising will target those under the legal drinking age of 21. Our next article, "FTC Report Focuses on Alcohol Marketing and Self-Regulation," takes a look at this FTC report.

 

According to FTC, an operator used deceptive earnings promises to recruit consumers for a multi-level marketing operation that was a pyramid scheme. That operator recently agreed to settle FTC charges. Our next article, "Alleged Pyramid Scheme Operator Settles FTC Charges," examines this FTC case.
